GDPR in HR

GDPR in HR concerns applying the European Union's General Data Protection Regulation to workforce information where it applies. It covers candidates, employees and other identifiable people whose data is processed.

Example

An employer provides a privacy notice, identifies a lawful basis for payroll processing and sets retention rules for unsuccessful applicants' information.

What to keep in mind

Consent is not automatically the right basis in employment because of the power imbalance. Check territorial scope, special-category conditions and local employment rules; the UK has a separate UK GDPR regime.
