Misconduct

Misconduct is behaviour that breaches applicable workplace rules or legitimate standards of conduct. Its classification and consequences depend on the facts, policy and law.

Example

An employer investigates an allegation that an employee knowingly ignored a required security procedure and considers the explanation before reaching a finding.

What to keep in mind

Distinguish deliberate or culpable conduct from lack of skill, unclear instructions or system failure. A policy allegation does not establish guilt, and any response should follow a fair and proportionate process.
